Writ Petitions
Writ proceedings before the Supreme Court of India and the High Courts against action by the State, public authorities and regulators.
Our practice
The firm appears in writ petitions under Article 32 of the Constitution before the Supreme Court and under Article 226 before the High Courts. The work often arises from the firm’s insolvency and real estate practice, where a statutory authority, a regulator or a public body is a party to the dispute.
Matters handled
- Challenges to orders and actions of statutory authorities, development authorities and regulators
- Matters concerning homebuyers and allottees against public authorities in stalled projects
- Challenges where a statutory remedy is unavailable or inadequate, or where a question of jurisdiction or natural justice arises
- Interim relief and urgent mentioning
- Special leave petitions and appeals before the Supreme Court
Approach
Writ jurisdiction is discretionary, and the existence of an alternative statutory remedy is often the first question a court will ask. The firm assesses at the outset whether a writ is the appropriate remedy, and builds the petition on the record so that relief may be granted on the documents.
