Real Estate & Homebuyers

Representation of apartment owners’ associations and allottees in stalled and delayed projects.

Our practice

The firm represents associations of apartment owners and allottees in projects where the developer has defaulted or is in insolvency. The work spans the NCLT and the NCLAT, the Real Estate Regulatory Authority, consumer commissions and writ proceedings, and often turns on how the allottees are organised and represented.

Matters handled

  • Claims of allottees as financial creditors in the CIRP, and representation through authorised representatives
  • Project completion proceedings and resolution plans for real estate companies
  • Formation, registration and rights of apartment owners’ associations, including the transfer of maintenance
  • Complaints before the Real Estate Regulatory Authority and consumer commissions
  • Writ petitions against development authorities in stalled projects

Approach

An association that acts early, with complete records of allotment and payment, is better placed to protect the interests of its members. The firm works with associations from the first meeting to the final order.
